Put creating a prenuptial agreement on your wedding to do list

It's estimated that four million Americans got engaged this past Valentine's Day. And while this was surely a very memorable day for most, this means that now is also the time that many of those engaged couples should start to think about creating prenuptial agreements.

Of course for many, creating a prenuptial agreement does not sound like the most romantic time, but in all reality, being open and honest about finances now can lead to less disagreement later on down the road.

Know your finances for a fair divorce settlement

Divorce can be complicated and frustrating. Because of this, it's normal for a person to want to just fill out the paperwork as quickly as possible and just get the entire process of divorce over and done with. However, if a person rushes too much and doesn't put the time into properly filling out all assets, liabilities and expenses, one spouse can find themselves at an unfair disadvantage when it comes to the divorce settlement.

When filing for a divorce, spouses fill out a financial affidavit of some sort. Sometimes, when these are being filled out people tend to either estimate or guess at the information. Often these inaccuracies are due to either not knowing how to find the information that is needed, or not even having access to that information.

Financial disparity plays role in child custody battle

In our last post we talked about how child support in Nevada is based on a formula that takes into account the income of both parents. However, in some family law cases, income can also play a role when it comes to child custody battles.

Right now, R&B singer Usher's ex-wife, Tameka Raymond, is asking the courts to force Usher to not only pay more in child support, but to also pay her associated legal fees for the couple's ongoing child custody battle. She claims this would level the playing field since there is such a disparity in their incomes. Specifically, she is asking for $50,000.

Father arrested after failing to pay child support for 11 years

In family law cases, child support is something that should be taken very seriously. In Nevada, there is a child support formula that is pretty straightforward that evaluates how much each parent makes, and other financial factors. Once the amount is reached -- and agreed upon -- it then becomes the legal obligation of the one parent to pay child support. This legal obligation means failing to pay would be considered against the law.

One 61-year-old doctor is finding this out firsthand. The ear, nose and throat specialist was recently arrested after attempting to enter into Mexico. This was after more than 11 years of not paying his court-ordered child support.

Man denied visitation rights to the adopted child of his ex-wife

In an emotional family law case, a man was denied the right to visit the 3-year-old boy he says he raised as his son. The boy was adopted by the man's former wife, but the man never filed the stepparent adoption papers that would have given him legal parental rights.

At stake is the question of whether filing the papers was a "mere technicality," as the husband contends, or whether bending the law to make an exception in this case would have a confusing effect on how other cases in the family court are decided.

Many times the process of divorce can be very emotional. But, there is also a financial side, which is one that needs to be taken very seriously to ensure that assets are split fairly. Unfortunately, everything can seem rather overwhelming at first, and many people going through divorce don't even know where to start when it comes to the division of assets.

Child custody case 10 years after mother fled with kids

More than 10 years ago a mother went to pick up her two children from their father's house for visitation time. However, instead of returning the children back to their father, who had temporary custody, the mother fled with the children to another state. As of now, she has pleaded not guilty to an interference with child custody charge.

The case goes back to 2001 when the father was granted temporary custody of the couple's two children. In that decision, a circuit court judge decided that ever since the couple's 1999 divorce, the mother's employment and living situation had been unstable.

Learn about your finances after a divorce

When going through a divorce, an individual may not be entirely aware of their finances. In some marriages, one spouse takes care of the finances and the other doesn't know what is going on. This means one spouse may not know how much is in the bank accounts, what insurance policies exist and how the retirements accounts will work.

Of course for someone who recently got divorced -- or is thinking of divorce -- getting a hold of your finances can seem somewhat scary. Luckily, by just creating a to-do list, and possibly talking with a legal professional, you can get yourself on the right path to complete financial control.

Heidi Klum and Seal announce decision to split

In the past several weeks of what has been dubbed "Divorce Month," a number of celebrities have announced their decisions to file for divorce. And while in our last post we talked about actress Zooey Deschanel's recent "amicable" split from musician husband Ben Gibbard, now Heidi Klum and Seal have also decided to end their marriage.

Klum and Seal have been married for the past seven years; and have often made headlines for what seemed like their complete adoration for each other as the two renewed their wedding vows every year. She without him: Zooey Deschanel to divorce Ben Gibbard

"She and Him" singer and actress Zooey Deschanel recently filed to divorce her musician husband Ben Gibbard. The two describe the split as "amicable" and this split is not expected to feature the drama that is common in celebrity divorces.

Deschanel recently attached an income and expense declaration to her court filings which indicates that she carries no debt and has a sizable amount of money stored in stocks and checking accounts. Many Las Vegas spouses who are equally as responsible with their finances are shocked to learn that their prudence may not be rewarded during the property division process. Community property rules apply to Nevada residents. This means that even couples who keep separate finances have to split their assets during a divorce.
